Providing for future employment of spouse unemployed at time of agreement. This Agreement is made this _________, 19__, in _________, _________, by and between _________, "wife" and _________, "husband." Recitals The parties are residents of _________ County, _________. The parties were lawfully married on _________, 19__, in _________, _________. There was one child born of the marriage of the parties namely: _________, age _________ years (the "minor child"). The minor child is now living with wife. Unfortunate and irreconcilable difficulties and differences have arisen between the parties, as a result of which they are not now living as husband and wife. Wife has filed a Petition for Dissolution of Marriage in the _________ Court of _________ County, _________, Case No. _________ which action is still pending and undetermined. Wife is represented by Legal Assistance Foundation of _________ and _________, attorney, and husband is represented by _________ Volunteer Legal Services Foundation and _________, attorney, and the parties accordingly have the benefit of the advice of their respective legal advisors. The parties consider it to their best interest to settle between themselves now and forever their respective property rights or otherwise growing out of the marital relationship, or any other relationship now or previously existing between them, and which either of them may have or claim to have against the other, or to any property of every kind, nature, and description, whether real, personal, or mixed, all rights and claims of every kind, nature and description which either of them may have or claim to have against the estate of the other. Each party has made full disclosure to the other of all properties owned by each of them and of the income derived from them and from all other sources, and are fully advised as to their rights in relation to them. Therefore, in consideration of the mutual and several promises in this agreement and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, the parties freely and voluntarily agree as follows: 1. Maintenance: Both husband and wife shall waive all right to maintenance, formerly called alimony as to all times past, present, and future. 2. Child Custody: Wife is a fit and proper person to and shall have the care, control, custody, and education of the child during his minority. Wife shall keep husband informed of the child's progress, health, school record, and activities. Husband and wife shall both keep each other informed as to their home addresses and telephone numbers. 3. Child Visitation: For the first six months after the date this agreement is fully executed, husband shall have visitation rights with the minor child every other Sunday from noon until 4 p.m. Thereafter, husband shall have reasonable visitation rights with the minor child, to include at least one full day each week and, on occasion, an entire weekend from Friday evening through Sunday evening. Such weekend visitation shall be as the parties agree, but if there is no agreement, then no less frequently than once each month. Husband shall give wife reasonable notice prior to such visitations. 4. Child Support: Husband is currently unemployed and has no regular source of income. Upon his obtaining employment, he shall pay to wife 20% of his net income from all sources for support during the child's minority. Husband will notify wife within 7 days of his obtaining employment. Husband will provide to wife verification of his income once yearly in the form of a copy of his W-2 form. 5. Life Insurance: Upon his obtaining employment, husband shall obtain and maintain in full force and effect an insurance policy on his life naming the minor child as the irrevocable beneficiary until he reaches the age of 18 or is otherwise emancipated. 6. Health Insurance and Medical Bills: Upon obtaining employment, husband shall obtain and maintain health and major medical insurance on the child during his minority. Wife shall be responsible for purchase and payment of her own health insurance and medical bills. Husband shall pay those medical and dental bills of the minor child which exceed $50 per occurrence, illness, or event. Other than in an emergency, wife shall consult with husband prior to incurring any indebtedness for which husband shall be expected to pay under this paragraph. 7. Indebtedness: The parties have no joint debts and each is responsible for his or her own debts which have been incurred since the date of their separation. 8. Property: A. Real Estate. The parties own no real estate, in either joint or sole tenancy. B. Personal Property. The parties have divided their marital and nonmarital personal property to their mutual satisfaction. 9. Effect of Agreement: The husband and wife agree that no modifications to this agreement shall be effective unless made in writing. Husband and wife agree that this document constitutes a complete adjustment of their property rights and that this agreement constitutes the total agreement of the parties. Husband and wife agree that this agreement shall be submitted to the court for approval and if approved shall be made part of the judgment of dissolution, and shall be of effect and binding only if a judgment for dissolution is entered in the pending case in the _________ Court of _________ County. In witness, we have signed this agreement freely and voluntarily on the date first above written.
